Digital Evidence Verification In The Age Of AI
A recent trip to Chicago for Relativity Fest 2025 offered a powerful lesson in perception. After a sunrise run, I saw a promotional billboard being installed in my hotel lobby that read, “I crushed the Chicago Marathon.” I posed for a photo with it, even though I had not participated in the race. This simple act is a perfect reminder of how easily images can mislead a viewer.
That sign highlighted a clear risk we face every day. An image and a timestamp might look like solid proof, but they should never be taken at face value. Photos and videos can be staged, manipulated, or completely misinterpreted. The metadata that accompanies these files, such as timestamps and location data, can be edited by anyone with malicious intent. A single photo, without context, can easily deceive someone scrolling through their social media feed.
The risks are growing rapidly with the rise of AI image generation and simple metadata editing tools. For example, while I did not try to make it look like me, the image below shows how easily AI can generate realistic and deceptive images in moments.

Why You Cant Trust a Photo at Face Value
The adage of “seeing is believing” is a more dangerous assumption than ever. Here are the key limitations of photo and video evidence today:
- Context is everything, and even authentic photos can be visually deceptive.
- The metadata that accompanies a file can be altered.
- AI makes fabricating evidence incredibly simple. Convincing fake photos can be created in minutes and are often nearly indistinguishable from real images.
- Video evidence is also vulnerable, with the prolific rise of deepfakes and deceptively edited clips.
“Convincing photo evidence can now be created in just minutes and is often nearly indistinguishable from authentic images.” -George Swoyer, Esq.
In forensic collections and litigation, creating a defensible case requires more than just accepting a picture or a timestamp as proof. When analyzing digital data, it is crucial to remain skeptical of what is presented and always seek corroboration when needed.
A Practical Checklist for Verifying Digital Evidence
Here is a quick five-step checklist to consider when you need to validate photo or video evidence:
- Always ask for the original, native files. Screenshots can strip or alter important metadata and may omit key details that are present in the source file.
- Review the EXIF metadata, such as the original date, time, and GPS data, but treat this information as just one data point, not as definitive proof.
- If you doubt an image’s authenticity, perform a reverse image search to see if older versions or duplicate copies of the image exist online.
- Corroborate the image with other data sources. This can include telemetry data like phone location history, fitness app logs, navigation app data, server logs, or witness statements.
- For high-stakes matters, bring in a forensic analyst. They can examine device artifacts, review logs, and perform a full file system data extraction if necessary.
The Critical Role of Corroboration
Courts and regulators are scrutinizing digital evidence more closely than ever. A screenshot or a standalone photo without context may be thrown out if its authenticity is challenged. By adopting strong validation practices, legal and litigation support professionals can avoid costly problems like evidence spoliation, strengthen their arguments, and demonstrate diligence to all parties involved.
My "marathon photo" was just for fun, but it’s a stark reminder that images rarely tell the whole story. Just as I didn’t actually run 26.2 miles, many images used in litigation or shared on social media do not reflect reality. As eDiscovery and forensic professionals, our job is to dig deeper, verify our sources, and corroborate media files to ensure the digital evidence we rely on is defensible, complete, and true.
