Anthropic Settles Landmark AI Copyright Lawsuit With Authors

Artificial intelligence startup Anthropic has officially settled a major class-action copyright infringement lawsuit, bringing a temporary close to a high-stakes legal battle. According to a court filing, the company reached an agreement with a group of authors who accused it of training its AI models on their work without permission.

The Core of the Dispute AI Training and Copyright

San Francisco-based Anthropic, a prominent AI firm founded by former OpenAI employees and backed by Amazon, was sued in August 2024 by authors Andrea Bartz, Charles Graeber, and Kirk Wallace. The lawsuit alleged that the company's AI assistant, Claude, was trained using a vast library of copyrighted books, which the authors argued constituted a massive infringement of their intellectual property.

A Mixed Ruling Fair Use vs Piracy

The case took a significant turn when U.S. District Judge William Alsup delivered a partial win for Anthropic. He ruled that the act of AI models learning from copyrighted books could be considered "exceedingly transformative" and thus protected as "a fair use." This doctrine, which allows for limited use of copyrighted material without consent under certain circumstances, is a critical defense for AI companies facing similar claims.

However, the judge also found that Anthropic may have broken the law through its methods of acquiring the training data. The court determined the company pirated at least 7 million books from online libraries like Books3, Library Genesis, and the Pirate Library Mirror, which host unauthorized copies. Interestingly, the judge found that Anthropic's separate process of buying millions of print books and scanning them into digital form was within the bounds of fair use, calling the conversion alone a transformative act.

High Stakes and a Landmark Settlement

With the piracy claim upheld, the matter was ordered to trial in December to determine damages. This posed a monumental financial risk for Anthropic, with potential penalties reaching up to $150,000 per case of willful infringement, a figure that could have resulted in billions of dollars in damages. Underscoring the pressure, the AI company's attempt to appeal the ruling was denied in early August.

The settlement, whose terms were not disclosed, effectively halts the court proceedings. Justin Nelson, a lawyer for the authors, called the agreement a "historic settlement" that will benefit all class members, with more details expected in the coming weeks.

The Broader Context AI's Copyright Challenge

Anthropic's case is a key episode in a much larger story unfolding across the tech industry. Numerous AI companies are facing legal challenges over their use of copyrighted material for training data. In a recent example, major studios like Walt Disney Co. and Universal Pictures sued the AI image generator Midjourney, alleging it was trained on their copyrighted works.
